BikeWay Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the services offered by BikeWay ("we", "us", or "our"). Your access to and use of our motorcycle rental services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and customers who access or use our services.

1. Rental Agreement

By renting a motorcycle from BikeWay, you ("the Renter") enter into a binding agreement with us, governed by these Terms and the details specified in your Rental Agreement form.

2. Eligibility Requirements

To rent a motorcycle from BikeWay, you must meet the following requirements:

  • Be at least 21 years of age
  • Possess a valid motorcycle license or endorsement appropriate for the motorcycle being rented
  • Have at least 1 year of motorcycle riding experience
  • Present a valid driver's license and credit card in your name
  • Provide proof of motorcycle insurance or purchase our insurance option

3. Reservation and Payment

3.1 Reservation

Reservations can be made online, by phone, or in person at our Toronto location. A reservation is confirmed upon receipt of a deposit payment.

3.2 Deposit and Payment

A deposit of 25% of the total rental fee is required to confirm a reservation. The balance of the rental fee must be paid at the time of pickup. We accept major credit cards and debit cards.

3.3 Security Deposit

A security deposit ranging from CAD $500 to $2,500 (depending on the motorcycle model) will be authorized on your credit card at the time of pickup. This amount will be released upon the motorcycle's satisfactory return.

4. Cancellation Policy

  • Cancellations made 7 or more days before the rental date: Full refund of deposit
  • Cancellations made 3-6 days before the rental date: 50% refund of deposit
  • Cancellations made within 48 hours of the rental date: No refund
  • We may offer a rain check or reschedule option at our discretion for weather-related cancellations

5. Motorcycle Use and Restrictions

The rented motorcycle:

  • Must only be operated by the person(s) named in the Rental Agreement
  • Must be used in accordance with all applicable traffic laws and regulations
  • Must not be used for racing, off-road riding (unless specifically designated as an off-road motorcycle), or any illegal purposes
  • Must not be taken outside of Canada without prior written permission
  • Must not be operated under the influence of alcohol, drugs, or any substance that may impair the rider's ability
  • Must not be overloaded beyond its specified capacity

6. Renter's Responsibilities

As the Renter, you are responsible for:

  • Inspecting the motorcycle before departure and acknowledging its condition
  • Wearing appropriate safety gear at all times while operating the motorcycle
  • Securing the motorcycle properly when parked
  • Returning the motorcycle with the same fuel level as at pickup
  • Reporting any accidents, damage, or mechanical issues immediately
  • Adhering to the motorcycle's maintenance schedule for longer rentals

7. Insurance and Liability

7.1 Insurance Coverage

Basic insurance is included in the rental fee, covering third-party liability. Additional coverage options are available for purchase. The Renter's personal insurance may also apply.

7.2 Renter Liability

The Renter is responsible for damages to the motorcycle during the rental period up to the amount of the deductible (varies by coverage selected). The Renter may be fully liable for damages resulting from prohibited uses of the motorcycle.

8. Accidents and Damages

In case of an accident or damage to the motorcycle, the Renter must:

  • Ensure the safety of all parties involved
  • Report the incident to the police if required by law
  • Contact BikeWay immediately
  • Not admit liability or make any offers to third parties
  • Obtain names, addresses, and contact information of all parties involved and any witnesses
  • Complete an accident report form provided by BikeWay

9. Late Returns

Late returns will incur additional charges at our hourly rate. If the motorcycle is not returned within 24 hours of the scheduled return time and no communication is received, it may be reported as stolen.

10. Mechanical Failures

In case of mechanical failure not caused by the Renter, we will:

  • Provide roadside assistance where available
  • Arrange for repairs or replacement if possible
  • Refund the prorated rental fee for the period the motorcycle was unusable

11. Termination of Rental

BikeWay reserves the right to terminate the rental and repossess the motorcycle at any time if the Renter violates these Terms, provides false information, or operates the motorcycle in an unsafe manner.

12. Modifications to Terms

We may modify these Terms at any time. The most current version will be posted on our website. Your continued use of our services after any changes constitutes acceptance of those changes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
